Operating rules

Terms of rental for xRover multifunctional medical wheelchairs/strollers, the ePower Assist drive and accessories.

I. Introduction

These operating rules govern the terms of rental of xRover multifunctional medical wheelchairs/strollers and their accessories between Volter s.r.o. (the “lessor”) and the customer (the “lessee”).

The subject of the rental includes in particular:

The legal relationship is governed by Act No. 89/2012 Coll., the Civil Code, and by these operating rules.

II. Subject of rental

The lessor hands over the subject of the rental to the lessee for temporary use in a state suitable for proper use.

The subject of the rental is specifically identified in the handover protocol, including serial number or other identifier.

Only a person over 18 years of age may be a lessee. The lessee is required to present 2 valid identity documents.

III. Rental start and handover

The rental begins upon receipt of the subject of the rental and payment of the rent and deposit.

Handover and return take place at the lessor’s premises unless agreed otherwise.

The subject of the rental is handed over clean, fully functional and ready for use. In the case of the electric drive, the battery is handed over fully charged.

By taking over the subject of the rental, the lessee confirms its technical condition and completeness.

IV. Rental period

The rental is agreed for a fixed term as agreed between the parties.

If the lessee is in delay with returning the subject of the rental, the lessor is entitled to charge rent for each commenced day in accordance with the price list.

If the lessee fails to return the subject of the rental within 3 days after the end of the rental, the lessor is entitled to consider the subject of the rental as not returned and to proceed according to the provisions on compensation for damages.

VII. Deposit and damage

Before taking over the xRover wheelchair/stroller, the ePower Assist drive and/or accessories, the lessee is obliged to pay a deposit in the amount set out in the lessor’s current price list for each rented item.

The deposit serves to secure the lessor’s claims, in particular in the event of damage to the subject of the rental, its loss or theft, damage to accessories, or delay in its return.

The lessee is responsible for returning the subject of the rental in the condition in which it was received, with allowance for normal wear and tear.

If during the rental period the subject of the rental or its parts are damaged, destroyed, lost or stolen, the lessor is entitled to set off against the deposit the costs of remedying the damage, in particular costs of repair, spare parts, service work or compensation for damage.

In the event of destruction, loss or non-return of the subject of the rental, the lessee is obliged to pay damages in the amount of the customary (residual) value of the subject of the rental as of the date the damage occurred, taking into account its age, wear and technical condition.

The lessor is entitled to unilaterally set off from the deposit in particular:

The deposit is refunded after the returned subject of the rental has been inspected.

In the case of a set-off, the lessor is obliged to return the remaining part of the deposit to the lessee within 14 days of the date the settlement is made.

If the amount of damage exceeds the deposit paid, the lessee is obliged to pay the difference within 14 days of the delivery of the damage statement.

VIII. Return

The subject of the rental must be returned on time and in a corresponding condition, including all rented accessories.

In the case of excessive soiling, cleaning may be charged.

IX. Liability for injuries

The lessee acknowledges that the use of the xRover wheelchair/stroller, the ePower Assist drive and accessories is associated with certain risks and takes place at the lessee’s own responsibility.

The lessor recommends using suitable protective equipment (e.g. helmet, safety belts, fixation elements) and observing the safety of the transported person and the accompanying person.

The lessee is obliged to use the subject of the rental in such a way that the health of the lessee, the transported person and third parties is not endangered.

The lessor is not liable for damages to health or property arising in connection with the use of the subject of the rental, unless such damages were caused by a breach of the lessor’s obligations.

X. Personal data

Personal data is processed for the purpose of fulfilling the contract.
